Make Page Six a Preferred Source Halle Berry hit back at ex-husband Olivier Martinez in new court docs, accusing him of influencing their son Maceo to be “angry and combative” towards her.
The actress asked the court to reinstate her 50/50 custody agreement for Maceo, 13, in court docs obtained by People Monday.
The filing comes after Martinez was granted primary custody of Maceo as well a a temporary restraining order against her, alleging she choked Maceo during an argument and has been abusive towards him.
Berry alleges in the new docs that Martinez causes Maceo to be angry at her due to his “continued attempts to align Maceo with him and against me in many areas of our child’s life and activities.”
“When Maceo would come home from his custodial time with Olivier, he would be angry and combative,” she alleges in the docs.
“I also perceived Maceo to repeat disputes that Olivier and I discuss in private and take Olivier’s side/position in that dispute,” she also claims.
According to the docs, Martinez’s behavior has led their son to completely disregard Berry’s authority as his mother, and she claims Maceo has personally been negatively affected.
“[Martinez’s] refusal to allow early interventions have caused Maceo to fall further behind in school, caused Maceo’s acting out behaviors to worsen, and caused further damage to Maceo’s and [Berry’s] relationship,” she claims in the docs.
Per the new filing, Martinez has allegedly refused to accept Berry’s relationship with her fiancé, musician Van Hunt. Berry claims Martinez doesn’t allow Maceo to undergo family therapy with her and Hunt, with the purpose of creating a healthy blended family.
The Oscar winner is also asking the court to force Martinez to attend their court-ordered therapy sessions.
The French actor filed a response and asked the court to deny Berry’s request, People reported.
Berry and Hunt were spotted spending time with Maceo Sunday in pics obtained by Page Six. The trio went to Sky Zone in Los Angeles in photos obtained by Page Six, and were accompanied by some of the teen’s friends.The outing comes after Martinez alleged in his court filing that on Sept. 26, the “Monster’s Ball” actress jumped on Maceo, put her hands around his neck and choked him after the two got into an argument over him playing a virtual reality game.
Furthermore, Martinez alleged that Berry has been abusive toward their son on multiple occasions and that this wasn’t an isolated incident: “Throughout the last year and a half, Ms. Berry had wrestled Maceo to the ground and forced him to ‘tap out.’”
The “S.W.A.T.” star included private text messages in the filing, in which Maceo pleaded with his dad to pick him after his mom allegedly choked him.
Berry denied Martinez’s shocking allegations against her through her attorney, who called his filing “entirely meritless and deliberately misleading.”
“There is voluminous evidence, including numerous judicial rulings, that Olivier Martinez repeatedly violated court orders and interfered with necessary therapeutic and educational interventions to the detriment of his and Halle Berry’s minor son Maceo — misconduct for which Mr. Martinez has already been legally sanctioned,” the actress’ attorney, Marina Beck, shared in a statement with Page Six.
Berry and Martinez, both 60, first met on the set of their film, “Dark Tide,” back in July 2010. They tied the knot in July 2013 and were married for two years, before splitting in October 2015.
Their extremely contentious divorce took eight years to finalize.
