Add The New York Post on Google The holdout juror who caused Lindsay Clancy’s mistrial has a history of alleged domestic violence such as grabbing his wife by the throat and punching his nephew, according to a report.
The still-unnamed juror, only described as a black man in his 30s, faced a criminal charge in September 2021 for allegedly assaulting his wife, NBC10 Boston reported.
A 13-year-old nephew of the man called 911, stating that his uncle grabbed his wife by the throat and threw her into a dresser, according to a police report obtained by the outlet.
The juror’s own mom repeatedly screamed, “You’re evil!” as he was cuffed during the incident, the report said.
The juror recently ended up singlehandedly thwarting a verdict in Clancy’s sensational trial by refusing to agree with the 11 other jurors who found her not guilty by reason of temporary insanity after she fatally strangled her three young children in the family’s Duxbury, Mass., home.
A juror questionnaire in Massachusetts asks whether someone has been arrested, charged with a crime, or been served with a court order — all boxes that the holdout juror should have checked.
“I don’t see how they would’ve allowed him to be a member of this jury,” legal analyst Michael Coyne told the outlet.
Court records show that the juror divorced his wife after the alleged violent 2021 incident and that the criminal charge against him was dismissed — although his ex-wife said she backed away from pursuing the case because she was worried that testifying could cause her to lose custody of her daughter, the outlet reported.
Last year, the same teenage nephew took out a restraining order against the juror, alleging he pushed him to the ground and pummeled him in the face.
In an affidavit obtained by the outlet, the nephew alleged that his uncle said, “You ruined my (expletive) life” for calling the police and added, “You’ve had this coming your way for a long time.”
The restraining order remained active when the juror was selected for the Clancy trial and as he listened to six weeks of macabre testimony in which the former nurse said she was in the throes of postpartum psychosis when she murdered her kids Cora, 6, Dawson, 3, and Callan, 8 months.
The man also faces a pending eviction case by his landlord for $12,000 of unpaid rent, the outlet reported.
A family member also told the outlet that the man, who has been estranged from his family, was “a narcissist,” and that she believes he should not have been part of the high-profile trial.
The revelations come as another male juror alleged that the lone juror on the 12-person panel wrapped one of the exercise bands Clancy used to kill her children around a water bottle to mimic their strangulation in the deliberation room.
Juror number 10 Nick Dargie said the holdout had every right to his opinion but that the reenactment using the same exercise bands left the room speechless.
“I was so shocked. We’re not here to play detective – it’s not a game of Clue. This is serious,” Dargie, 25, told ABC’s “GMA” in an interview that aired Thursday morning.
“I asked him why are you doing that? That’s a band that was used to strangle a child. That’s disgusting.”
Dargie also said the unidentified man seemed disengaged during deliberations and refused to explain why he didn’t agree with the 11 other members who believed Clancy was not guilty by reason of insanity.
Clancy, 36, remains in a state-run psychiatric facility, Tewksbury Hospital. Her next hearing is scheduled for Sept. 29.
