Add The California Post on Google A Christian In-N-Out worker is suing the fast food giant claiming religious discrimination after she was allegedly forced to work Sundays.
Arianna Rodriguez, who was a cook at the location in Long Beach, California, for nearly five years claims she was wrongly terminated by a new manager.
According to the lawsuit, obtained by TMZ, Rodriguez had been on a schedule that allowed her to attend church on Sundays without any problems for years.
But when a new manager arrived in October, she claims her Sunday availability suddenly became a “recurring source of workplace conflict.”
She also alleges she received her first-ever disciplinary write-up during the period.
By December, Rodriguez says she took her concerns up the management ladder, raising issues surrounding her schedule, church attendance and what she believed was unfair treatment.
According to the suit, she felt her complaints fell on deaf ears. But the biggest blow-up allegedly came months later.
On June 24, Rodriguez claims an incident involving food landed her in hot water. She claims she believed the conduct amounted to food waste based on practices she had previously seen at the restaurant.
Instead, Rodriguez alleges, In-N-Out sent the matter to human resources, suspended her and launched an investigation.
The lawsuit does not make clear exactly what happened with the food, but Rodriguez claims she wasn’t the only employee who had engaged in similar conduct.
She alleges other workers were merely warned while she was suspended and ultimately fired. Rodriguez claims in the suit she went back to HR to complain about what she considered unequal treatment.
On July 3, she alleges, In-N-Out fired her over an alleged violation of company policy.
Rodriguez is suing the burger chain for religious discrimination, wrongful termination and other claims. She is seeking unspecified damages, unpaid wages and reinstatement to her job.
The California Post reached out to In-N-Out for comment.
