Guardianship Law
Protecting people who cannot protect themselves.
Overview
Florida guardianship law gives families a legal mechanism to protect adults who, because of dementia, disability, or cognitive decline, can no longer manage their own affairs — and minors whose parents are unable to. Guardianship is invasive by design: it strips legal rights from the ward and assigns them to the guardian. Our practice handles establishment, alternatives to guardianship, and disputed guardianship proceedings.
What we handle
- Establishing voluntary and involuntary guardianship
- Alternatives — durable POA, healthcare surrogate, supported decision-making
- Guardianship disputes and emergency guardianship
- Annual accountings and reporting
- Termination and restoration of capacity
